1. Acceptance of Terms

By accessing and using LINK-AI's website and services, you agree to comply with and be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.

2. Services Description

LINK-AI provides business-to-business (B2B) AI consulting and development services, including:

  • Custom AI chatbot development
  • Intelligent agent creation
  • Orchestrated agentic AI systems
  • AI transformation consulting
  • AI workshops and training

Our services are tailored to meet your specific business needs and requirements.

3. Website Features

3.1 AI Chatbot

Our website features an AI-powered chatbot to assist visitors. By using the chatbot:

  • Your messages are processed by OpenAI's GPT-4o-mini model
  • Conversations are logged for quality improvement purposes
  • No personal data is shared with third parties beyond OpenAI for message processing
  • Do not share sensitive personal or financial information via the chatbot

3.2 Client Dashboard

If you are a LINK-AI client, you may have access to a dedicated client dashboard where you can:

  • Track your project progress
  • View deliverables and milestones
  • Receive notifications from your project team
  • Access project documentation

Dashboard access credentials are confidential and should not be shared with unauthorized parties.

4. Custom Development Agreement

Each custom development project is governed by a separate agreement that outlines:

  • Project scope and deliverables
  • Timeline and milestones
  • Pricing and payment terms
  • Ownership and intellectual property rights
  • Confidentiality provisions

5. Your Responsibilities

You agree to:

  • Provide accurate and complete information about your business needs
  • Cooperate with our team during the development process
  • Provide necessary API access, accounts, and credentials for project duration
  • Review and approve deliverables in a timely manner
  • Make payments according to the agreed schedule
  • Use our services in compliance with all applicable laws and regulations

6. Intellectual Property Rights

Your Code, Your Property: All custom AI solutions, source code, and systems developed by LINK-AI for your project are owned by you upon completion and full payment. This includes:

  • All source code files
  • Configuration files and documentation
  • Custom prompts and AI configurations
  • Integration code and APIs developed for your systems

We retain only the right to use general methodologies, techniques, and non-proprietary knowledge gained during the project.

7. No Vendor Lock-In

You are free to modify, update, maintain, or transfer the custom AI solutions we develop for you without restrictions. You have complete ownership and control of your AI systems. We will provide all necessary documentation and credentials upon project completion.

8. Data Ownership

All data used to train or configure your custom AI systems remains your property. We do not claim ownership of your business data or insights generated from your data. Upon project completion or termination, we will delete any copies of your proprietary data from our systems.

9. Payment Terms

Unless otherwise specified in your project agreement, our standard payment structure is:

  • 50% deposit upon project approval and before development begins
  • 50% final payment upon project completion and delivery

Accepted payment methods include bank transfer and other methods agreed upon in your project agreement. All prices are quoted in USD unless otherwise specified.

10. Partnership and Support

LINK-AI is committed to long-term partnerships. Our standard project engagements include:

  • One-year partnership period for ongoing support and guidance
  • Bug fixes and critical updates during the partnership period
  • Technical consultation for modifications or expansions
  • Priority access to new features and improvements

Extended support beyond the partnership period is available through separate maintenance agreements.

11. Limitation of Liability

To the maximum extent permitted by law, LINK-AI shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the total amount paid for the specific service

This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.

12. Warranty and Guarantee

We stand behind our work and will fix any issues related to our development at no additional charge for a period specified in your project agreement (typically 90 days post-delivery). This warranty covers:

  • Bugs and defects in delivered code
  • Functionality not meeting agreed specifications
  • Integration issues with specified systems

The warranty does not cover issues arising from modifications made by third parties or changes to external APIs and services beyond our control.

13. Confidentiality

Both parties agree to maintain strict confidentiality of proprietary information shared during the course of the project and after its completion. This includes:

  • Business processes and strategies
  • Technical specifications and architectures
  • Customer data and business metrics
  • Pricing and financial information

Confidentiality obligations survive the termination of any project agreement.

14. Termination

Either party may terminate a project agreement with 30 days written notice. Upon termination:

  • Work completed to date will be delivered
  • Payment is due for work performed
  • All client data and credentials will be returned or destroyed
  • Confidentiality obligations continue to apply

15. Modification of Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email to registered clients. Continued use of our services after changes constitutes acceptance of the modified terms.

16. Governing Law and Dispute Resolution

These Terms of Service are governed by and construed in accordance with applicable laws. For dispute resolution:

  • First Step: Good faith negotiation between parties
  • Second Step: Mediation by a mutually agreed mediator
  • Third Step: Binding arbitration as a final resolution method

The governing law and arbitration venue shall be mutually agreed upon between LINK-AI and the client at the start of each project engagement, taking into account both parties' locations.

17. Restricted Access

Access to our website and services may be restricted based on geographic location. We reserve the right to block access from certain countries or regions in compliance with applicable laws and for security purposes.
